Terms of Use

1. Acceptance of Terms

By accessing or using astarimaging.com, creating an account, requesting photography services, purchasing photos, downloading files, or sharing album links, you agree to be bound by these Terms of Use. If you do not agree, please do not use ASI.

2. Your Account

You must create an account to purchase photos. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us immediately if you suspect any unauthorized use. ASI account features are not intended for children under 13.

3. Purchasing Photos

Photos are available for purchase as digital downloads, individual photos, or album packages where offered. Prices are displayed in the currency shown at checkout; applicable taxes are calculated before payment is completed. Payments are processed by our payment provider. ASI does not store your card details.

Digital photo sales are generally final once access is provided. This does not limit any non-waivable rights under applicable consumer protection law. If a purchased file is unavailable, corrupted, duplicated in error, or materially not as described, contact us and we will provide a replacement, re-enable access, or refund where appropriate.

4. Download Links

Upon completing a purchase, you may receive secure, time-limited download links by email and through your account. Links may expire for security reasons. Purchasers can re-access eligible downloads through their account while the order remains available. If you cannot access a purchased photo, contact us at privacy@astarimaging.com and we will review the issue.

5. Album Packages and Share Links

Album packages may include share links that allow invited recipients to view shared album previews and, where permitted, download eligible files. Share links are for personal sharing with appropriate family, team, or event recipients only. You are responsible for sharing links carefully. ASI may revoke, rotate, disable, or limit share links for privacy, safety, legal, security, support, or misuse reasons.

6. Intellectual Property and Licence

All photographs on ASI are owned by All Star Imaging or the respective event photographers and are protected by Canadian copyright law. Purchasing a photo grants you a personal, non-exclusive, non-transferable licence to download, print, and share the image for personal, non-commercial purposes only. You may not resell, redistribute, sublicense, use any photo for commercial purposes, remove watermarks from previews, or imply endorsement by ASI, a photographer, participant, team, league, school, or event organizer without our prior written consent.

7. Event Authority and Minor Participants

If you request photography services, submit event information, purchase or manage photos for a team, or act on behalf of a league, school, club, team, organization, parent, guardian, or participant, you represent that you have authority to do so and that all required consents, notices, permissions, and restrictions have been obtained and communicated to ASI before the event.

ASI must be notified in advance of any participant or attendee who must not be photographed, displayed, shared, or used in a particular way. ASI will make reasonable efforts to honour clear written restrictions, but cannot guarantee removal from every background or crowd image unless restrictions are provided in advance and are operationally feasible.

8. Prohibited Use

You agree not to:

• Share your account credentials with others
• Attempt to access, download, or copy photos you have not purchased
• Scrape, bulk download, bypass access controls, remove watermarks from previews, or interfere with gallery security
• Use the platform or any content for any unlawful or unauthorized purpose
• Use ASI photos or previews to harass, shame, identify, profile, exploit, or harm any person
• Use ASI photos or previews to train, test, or operate facial recognition, biometric identification, AI image-generation, surveillance, scraping, or profiling systems without ASI's prior written consent and all legally required participant or guardian consents
• Interfere with or disrupt the security or operation of our platform

9. Photographer and Contributor Responsibilities

Photographers and other contributors who upload or provide photos, event information, or related content to ASI are responsible for ensuring that they have the rights, permissions, releases, and authority required to provide that content and allow ASI to host, display, sell, deliver, support, and administer it through the platform. Photographers must not upload unlawful, exploitative, unsafe, misleading, or unauthorized content.

10. Privacy and Takedown Requests

If you believe a photo or gallery has been posted without appropriate authority, violates a no-photo/no-publish restriction, or creates a privacy or safety concern, contact us at privacy@astarimaging.com. ASI may remove, restrict, blur, disable sharing, or otherwise limit access to content while reviewing a request.

11. Limitation of Liability

To the fullest extent permitted by applicable law, All Star Imaging is not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability for any claim relating to a purchase is limited to the amount paid for the relevant order.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Canada and the Province of Ontario, without regard to conflict-of-law principles.

13. Changes to These Terms

We may update these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date. Continued use of the platform after such notice constitutes your acceptance of the revised Terms.
